Module 6: Human Rights

GOALS

After completing this module you will understand:

  • That workplace harassment, based on a prohibited ground, is discrimination under Saskatchewan’s human rights laws.
  • When a report can be made to the Saskatchewan Human Rights Commission.
  • The complaint process.
  • What happens after a complaint has been investigated.
  • When there will be a court case and the remedies courts can order if there has been discrimination.

When Harassment is Discrimination

Harassment by another employee and harassment by an employer are both prohibited forms of discrimination under human rights laws if it is based on prohibited grounds.

Reporting Discrimination

People can report discrimination to the Saskatchewan Human Rights Commission by completing an intake questionnaire that details what happened.

Resolving Complaints

After a complaint is made the Commission will help the parties try to resolve the matter by agreement. If it cannot be resolved by agreement there will be an investigation after which the Chief Commissioner will decide what other steps, if any, need to be taken.

Court Hearings

After the investigation the case can be referred to court for a hearing. In most cases parties must first try to resolve the matter through mediation before the court hears the case. If the court finds there has been discrimination there are a number of orders they can make.
