Reporting Discrimination

People can report discrimination by filling out the intake form at no cost. After this if the issue is not resolved and there is reason to believe discrimination has occurred the person can be asked to sign a formal compliant.

Whether you are the person who believes you have experienced discrimination or the person it is alleged has discriminated there are several ways throughout the process to try to come to a resolution both parties can accept.

There is no fee to report discrimination to the Saskatchewan Human Rights Commission. People can fill out the online intake questionnaire or they can phone, mail or email the Commission if they cannot access it online or need help completing it.

The intake questionnaire gathers information such as...

  • contact information about the person who is making the complaint, the workplace and the individual complained about
  • details about the person’s job
  • information about whether they have already taken other action in relation to the complaint, and if so, their reasons for also bringing a human rights complaint
  • the type of discrimination they are complaining about (the form includes a drop down list of prohibited grounds - sexual harassment is listed separately from discrimination based on sex)
  • details about the complaint, including possible witnesses and what they might say
  • information about the person’s thoughts on the best way to resolve the matter
  • additional documents that could support the complaint

Pre-Complaint Resolution

In some cases, the intake consultant may see an opportunity to resolve the issue quickly through facilitating communication between the parties. The intake consultant’s role throughout this process is to remain neutral and unbiased. The process can also serve to help educate employers and workers about human rights violations and their consequences.

Formal Complaints

If an issue has not been resolved through pre-complaint resolution, the report of discrimination is reviewed to determine if it falls under The Saskatchewan Human Rights Code and if there is reason to believe discrimination has occurred. If so, the person who has reported discrimination will be asked to sign a formal complaint. The complaint is then served on the other party, such as the employer. The other party is given the opportunity to respond.
