GOALS

After this module you will understand:

  • How discrimination is reported to the Canadian Human Rights Commission and how to respond to a discrimination complaint.
  • The different ways that a complaint to the Canadian Human Rights Commission can be resolved.
  • When a case will go to the Canadian Human Rights Tribunal.
  • The process and steps when a case is referred to the Canadian Human Rights Tribunal.
  • The orders the Canadian Human Rights Tribunal can make if they find there has been discrimination.

Complaints

Harassment in the workplace based on a prohibited ground is a recognized form of discrimination under the Canadian Human Rights Act. The Canadian Human Rights Commission can investigate these harassment complaints.

Resolution

Once the Canadian Human Rights Commission has accepted a complaint the resolution process begins. There are a number of ways a complaint can be resolved.

Referral to the Canadian Human Rights Tribunal

The Canadian Human Rights Commission can refer a case to the Canadian Human Rights Tribunal.

Canadian Human Rights Tribunal Hearings

If the matter cannot be resolved through mediation there will be a hearing in front of the Canadian Human Rights Tribunal.
