Module 4: Complaints

GOALS

After completing this module you will understand:

  • The process for reporting an occurrence of workplace harassment or violence.
  • What needs to be included in a Notice of Occurrence of harassment or violence.
  • What happens when a Notice of Occurrence is filed.
  • When there will be an investigation, how it will be conducted and what happens after an investigation.
  • How employees can report an employer who violates the Canada Labour Code.

Occurrences

Under the Workplace Harassment and Violence Prevention Regulations an incident of workplace harassment or violence is called an occurrence and is reported using a Notice of Occurrence.

Receiving a Notice of Occurrence

There are a number of steps the employer, or person designated to receive a Notice of Occurrence, must take after a notice has been filed.

Investigations

If an occurrence of harassment or violence is not resolved by negotiation or conciliation the person who was harassed or experienced violence can require that the matter be investigated.

Compliance Complaints

Employers are required to comply with the Canada Labour Code and its regulations. If they do not employees can make a complaint.
