Role of Others

Depending on the size of the workplace there are others who are involved in dealing with harassment and violence in the workplace.

Workplaces that have 300 or more employees must have a Policy Health and Safety Committee. If the workplace has between 20 and 299 employees it must have a Workplace Health and Safety Committee. If there are less than 20 employees there must be a Health and Safety Representative.

The employer’s partner is the policy committee or if there is not a policy committee the workplace health and safety committee. If there are neither of these the health and safety representative is the employer’s partner.

Employers and their partner must work together to...

  • identify risks related to harassment and violence
  • develop preventative measures
  • implement preventative measures
  • create a workplace harassment and violence prevention policy
  • develop or identify training on workplace harassment and violence

The partner also works with the employer to review and update these things as required. If the partner and the employer cannot agree the employer has the final say.

Employers have certain obligations regarding their partner, that include...

  • ensuring they receive training in health and safety, including training about workplace harassment or violence, and are informed of their responsibilities
  • cooperating with them
  • responding, in writing, to recommendations they make within thirty days after receiving them, indicating what, if any, action will be taken and when it will be taken
  • ensuring the availability in the workplace of space, equipment and personnel necessary for their work
  • posting their names, workplace telephone numbers and work locations where it can be easily seen by employees
